The Certificate of Compliance with Mandatory Disclosure is required by Florida Family Law Rules 12.285. It is required for hearings seeking financial relief whether an initial proceeding or supplemental proceeding. It must be served on the other party for inspection and copying. The Rule provides deadlines for serving the Mandatory Disclosure in order that both parties have the ability to review the financial documents. The purpose of this exchange of documents is to prepare equitable distribution worksheets, analyze alimony issues, child support calculations as well as requests for attorney’s fees. The Rule provides a list of the required disclosure for personal banking and tax documents, corporate and trust tax returns, promissory notes, premarital agreements, post marital agreements. Failure to make this disclosure can result in the Court imposing sanctions.
The financial documents are not filed with the Court. Only the Certificate of Compliance listing the documents provided is filed with the court, which informs the court of compliance with the Rule.
